These Terms and Conditions govern the access, navigation, and use of the mobile

application and website DeliXpress, owned by Olive Garden Deli S.L., as well as the

contracting of services offered through the platform. By registering and using the

application, you acknowledge that you have read, understood, and fully accepted

these Terms and Conditions.

2. Purpose of the Service

DeliXpress is a technological platform that connects users, local businesses

(restaurants, shops, stores), and independent or employed couriers, to facilitate

the purchase,

collection, and delivery of products in the area of Arona and nearby locations

(South Tenerife).

DeliXpress is not a restaurant or store. Its role is purely technological — to serve as an

intermediary between users, establishments, and couriers, ensuring an efficient and safe

ordering and delivery process.

3. Acceptance of the Terms

Registering and using the application implies the full and express acceptance of

these Terms

and Conditions, as well as the Privacy Policy and Cookies Policy.

If you do not agree with any part of these terms, you must refrain from using

the application or the website.

4. User Registration

To use the services of DeliXpress, the user must:

Be at least 18 years old.

Create an account with accurate, complete, and updated information.

Provide a valid delivery address within the coverage area.

The user is responsible for maintaining the confidentiality of their password and account.

DeliXpress reserves the right to suspend or delete accounts containing false information,

violating the terms of use, or showing fraudulent activity.

5. How the Service Works

The user selects an establishment, adds products to the cart, and confirms the order.

DeliXpress sends the order to the selected establishment and assigns an

available courier.

3.

The user can track the order status in real time through the app.

The courier delivers the order to the user’s specified address.

Upon delivery, the user must validate receipt with a PIN code or confirmation

in the app.

DeliXpress acts as a technological intermediary, not as a direct supplier of the products.

6. Coverage Area

DeliXpress services are currently available in Arona (South Tenerife, Canary Islands) and

nearby zones. Users can verify service availability through the app before placing an order.

7. Purchase and Delivery Conditions

Prices shown include applicable taxes (IGIC).

Delivery fees are automatically calculated based on distance between pickup and

delivery locations.

Delivery times are estimates and may vary due to factors beyond DeliXpress’s control

(weather, traffic, availability, etc.).

The user must check their order upon delivery. In case of missing or

incorrect products,

the user should contact the establishment directly.

8. Payment Methods

DeliXpress accepts the following payment methods:

Credit or debit card (Visa, MasterCard).

Cash (in local currency, up to a maximum of €50).

The user must select the payment method before confirming the order.

Couriers do not carry card terminals and do not accept Bizum or alternative

payment systems.

9. Cancellation Policy

If the order has not yet been accepted by the establishment, it can be canceled free

of charge.

If the order is already being prepared, the cost of the products will be charged.

If the order has a courier assigned, the cost of the products and the delivery fee

will be charged.

Prepared food orders cannot be returned or refunded.

10. Tips and Ratings

Users may leave a voluntary tip for the courier directly through the app.

They may also rate the quality of service received from both the establishment

and the courier.

11. Responsibilities

DeliXpress shall not be held responsible for:

The quality, condition, or composition of the products provided by partner

establishments.

Delays or issues caused by external factors (weather, traffic, technical issues, etc.).

Any indirect or economic losses resulting from the use of the app.

Each establishment is solely responsible for complying with applicable sanitary, tax, and

commercial regulations.

12. Intellectual Property

All rights over the application, website, software, content, logos, images, databases, and

design are the exclusive property of Olive Garden Deli S.L. or its legitimate licensors.

Reproduction, distribution, or modification of any content without prior written

authorization is strictly prohibited.

13. Data Protection

The processing of users’ personal data is governed by the DeliXpress Privacy Policy,

in compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law

3/2018 (LOPDGDD) on data protection.

14. Modifications to the Terms

DeliXpress may modify these Terms and Conditions at any time.

Updates will be published on the application and website, taking effect from their

publication date. Continued use of the service after changes are posted implies

acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Spain, specifically those

applicable within the Autonomous Community of the Canary Islands. In the event of

a dispute or conflict, both parties expressly submit to the Courts and Tribunals of

Arona (Santa Cruz de Tenerife), expressly waiving any other jurisdiction that may apply.
